Email Notification Agreement

1. Overview

This Email Notification Agreement explains the types of emails ScaleFury sends, how we obtain your consent, and how you can manage your email preferences. We are committed to sending only relevant, valuable communications and respecting your inbox.

2. Consent

By creating a ScaleFury account, submitting a contact form, or opting in to our communications, you consent to receive emails from us. You may withdraw your consent at any time by following the unsubscribe instructions in any email or by updating your notification preferences in your account settings.

Certain transactional emails (account confirmations, security alerts, billing notifications) are required for the operation of your account and cannot be opted out of while your account is active.

3. Types of Emails

3.1 Transactional Emails

These are essential communications related to your account and service usage:

  • Account registration and verification
  • Password reset and security alerts
  • Billing confirmations, invoices, and payment receipts
  • Service updates, maintenance notices, and downtime alerts
  • Changes to our terms, policies, or features
  • Lead notifications (when someone submits a form on your website)

3.2 Marketing Emails

With your consent, we may send:

  • Product updates and new feature announcements
  • Tips, guides, and educational content about growing your business
  • Promotional offers and special pricing
  • Event invitations and webinar announcements
  • Customer success stories and case studies
  • Newsletters and industry insights

3.3 AI-Generated Communications

If you use ScaleFury's AI agents or campaign tools, the platform may send emails on your behalf to your customers and leads. You are responsible for ensuring these communications comply with applicable laws, including obtaining proper consent from your recipients.

4. Frequency

We aim to keep our communications relevant and reasonable. Marketing emails are typically sent no more than 2–4 times per month. Transactional emails are sent as needed based on your account activity.

5. Opt-Out and Preferences

You can manage your email preferences in the following ways:

  • Unsubscribe link: Every marketing email includes an unsubscribe link at the bottom. Click it to opt out of that category of emails.
  • Account settings: Log in to your ScaleFury account and navigate to notification preferences to customize which emails you receive.
  • Contact us: Email [email protected] to request changes to your email preferences.

We will process opt-out requests within 10 business days. Note that opting out of marketing emails does not affect transactional emails required for your account.

6. CAN-SPAM Compliance

ScaleFury complies with the CAN-SPAM Act. All emails we send:

  • Include a clear and conspicuous unsubscribe mechanism.
  • Identify the message as an advertisement where applicable.
  • Include our valid physical mailing address.
  • Use accurate “From” and “Subject” lines that are not misleading.
  • Honor opt-out requests within 10 business days.

7. Your Responsibilities

If you use ScaleFury to send emails to your own customers and leads, you are responsible for:

  • Obtaining proper consent from your recipients before sending marketing emails.
  • Providing a clear unsubscribe mechanism in your emails.
  • Complying with CAN-SPAM, GDPR, CASL, and other applicable email marketing laws.
  • Maintaining clean email lists and honoring opt-out requests promptly.
  • Not sending spam, deceptive, or misleading emails through the platform.
