1. Acceptance of Terms
By accessing or using the ScaleFury platform, website, or any related services (collectively, the “Services”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not use the Services.
These Terms constitute a legally binding agreement between you (or the entity you represent) and ScaleFury. If you are using the Services on behalf of a business or organization, you represent that you have the authority to bind that entity to these Terms.
2. Description of Services
ScaleFury is an all-in-one SMB growth platform that provides CRM, AI workforce agents, a central communications hub, email and SMS campaigns, SEO and listings management, website and reputation management, advertising tools, content services, and automation capabilities. Services are offered in DIY, done-with-you, and done-for-you engagement models.
3. Account Registration
- You must provide accurate, complete, and current information when creating an account.
- You are responsible for maintaining the confidentiality of your account credentials.
- You are responsible for all activities that occur under your account.
- You must notify us immediately of any unauthorized use of your account.
- You must be at least 18 years old to create an account.
4. Free and Paid Services
4.1 Free Tier
ScaleFury offers certain services at no cost, including the CRM with unlimited users, basic AI chat agent, and executive reporting dashboard. Free services may be modified or discontinued at our discretion with reasonable notice.
4.2 Paid Services
Paid plans are billed on a monthly or annual basis as specified at the time of purchase. Pricing is customized based on your business needs. All fees are non-refundable except as required by law or as explicitly stated in a separate agreement.
4.3 Cancellation
You may cancel your subscription at any time. Upon cancellation, you will retain access to paid features through the end of your current billing period. Free features remain accessible after cancellation. Your data remains yours — you can export it at any time.
5. Data Ownership
You own your data. All contacts, campaigns, content, and business data you create or import into ScaleFury remain your property. You grant ScaleFury a limited license to use your data solely to provide and improve the Services. You may export your data at any time, and we will delete your data upon account termination in accordance with our Privacy Policy.
6. Intellectual Property
The ScaleFury platform, including its software, design, logos, trademarks, and documentation, is owned by ScaleFury and protected by intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Services without prior written consent.
Content you create using ScaleFury (e.g., marketing materials, emails, social posts) belongs to you. We do not claim ownership over content you produce through the platform.
7. Acceptable Use
You agree to use the Services in compliance with all applicable laws and our Acceptable Use Policy. You may not use the Services to send spam, distribute malware, infringe on intellectual property, or engage in any illegal or harmful activity.
8. AI Services
ScaleFury provides AI-powered features including AI workforce agents, content generation, and automated responses. While we strive for accuracy, AI-generated content and actions may contain errors. You are responsible for reviewing and approving AI outputs before they are published or sent to your customers.
ScaleFury is not liable for any damages resulting from AI-generated content or automated actions taken by AI agents on your behalf.
9. Third-Party Integrations
ScaleFury integrates with third-party services (e.g., Google, Facebook, email providers). Your use of these integrations is subject to the respective third party's terms and privacy policies. We are not responsible for the availability, accuracy, or practices of third-party services.
10. Limitation of Liability
To the maximum extent permitted by law, ScaleFury shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising from your use of or inability to use the Services.
Our total liability for any claim arising from or related to these Terms or the Services shall not exceed the amount you paid to ScaleFury in the twelve (12) months preceding the claim.
11. Disclaimer of Warranties
The Services are provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Services will be uninterrupted, error-free, or secure.
12. Indemnification
You agree to indemnify and hold harmless ScaleFury, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Services, violation of these Terms, or infringement of any third-party rights.
13. Termination
We may suspend or terminate your access to the Services at any time for violation of these Terms, with or without notice. Upon termination, your right to use the Services ceases immediately. Provisions that by their nature should survive termination (including data ownership, limitation of liability, and indemnification) will remain in effect.
14. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts located in Delaware.
15. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the “Last updated” date. Continued use of the Services after changes constitutes acceptance of the revised Terms.
