Acceptable Use Policy

1. Purpose

This Acceptable Use Policy (“AUP”) sets out the rules for using the ScaleFury platform and services. It is designed to protect our users, our platform, and the broader community. All users must comply with this policy in addition to our Terms of Service.

2. Prohibited Conduct

You may not use ScaleFury to:

2.1 Spam and Unsolicited Communications

• Send unsolicited bulk emails, text messages, or other communications (spam).
• Send messages to purchased, rented, or scraped contact lists without proper consent.
• Use misleading subject lines, sender names, or “from” addresses.
• Fail to include a working unsubscribe mechanism in marketing messages.
• Ignore or delay processing opt-out requests.

2.2 Illegal Activities

• Engage in any activity that violates local, state, national, or international law.
• Promote, facilitate, or participate in fraud, money laundering, or financial crimes.
• Sell or promote illegal products, substances, or services.
• Violate export control or sanctions regulations.

2.3 Harmful Content

• Distribute malware, viruses, ransomware, or other harmful software.
• Engage in phishing, social engineering, or identity theft.
• Publish or distribute content that is defamatory, obscene, threatening, or promotes violence.
• Create or distribute content that exploits or harms minors.
• Publish content that infringes on intellectual property rights.

2.4 Platform Abuse

• Attempt to gain unauthorized access to ScaleFury systems, other user accounts, or data.
• Interfere with or disrupt the platform, servers, or networks.
• Reverse engineer, decompile, or disassemble any part of the Services.
• Use automated tools (bots, scrapers) to access the platform without authorization.
• Create multiple accounts to circumvent restrictions or abuse free tier limits.
• Resell or redistribute ScaleFury services without authorization.

2.5 Deceptive Practices

• Misrepresent your identity, affiliation, or the origin of communications.
• Use ScaleFury to impersonate another person or organization.
• Create fake reviews, testimonials, or social proof.
• Make false or misleading claims in advertising or marketing materials.

3. Email and SMS Specific Rules

In addition to the general prohibited conduct above, users who send emails or text messages through ScaleFury must:

• Comply with CAN-SPAM, TCPA, GDPR, CASL, and all other applicable messaging laws.
• Only send messages to recipients who have provided valid consent.
• Include accurate sender identification in all messages.
• Process opt-out requests within the timeframes required by law.
• Maintain bounce rates below 5% and spam complaint rates below 0.1%.
• Not send messages containing deceptive, misleading, or illegal content.

4. AI Usage Guidelines

When using ScaleFury's AI features, you must:

• Review AI-generated content before publishing or sending to ensure accuracy and appropriateness.
• Not use AI features to generate content that violates this AUP or any applicable law.
• Not attempt to manipulate AI systems to produce harmful, deceptive, or illegal outputs.
• Disclose the use of AI-generated content where required by law or industry standards.

5. Enforcement

ScaleFury reserves the right to investigate and take action against any violations of this AUP. Actions may include:

• Warning: A notice to cease the prohibited activity.
• Suspension: Temporary restriction of access to some or all Services.
• Termination: Permanent removal of your account and access to the platform.
• Legal action: Referral to law enforcement or pursuit of legal remedies where appropriate.

We may take action without prior notice in cases of severe violations or where immediate action is necessary to protect our users or platform.
